1. Our Services

Informal Negotiations

To expedite resolution and control the cost of any dispute, you and we agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration

If the parties are unable to resolve a dispute through informal negotiations, the dispute will be finally and exclusively resolved by binding arbitration. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

Restrictions

The parties agree that any arbitration shall be limited to the dispute between the parties individually. No arbitration shall be joined with any other proceeding, and no class arbitration or class action is permitted.

15. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

16. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT. WE ASSUME NO LIABILITY FOR (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (2) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES; (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS; OR (4) ANY BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS TRANSMITTED THROUGH THE SERVICES.

By providing your phone number and opting in, you consent to receive SMS text messages from Sound Mind Media Co. regarding our services, promotions, and updates. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message or contacting us directly.

22. California Users and Residents

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

23. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions.

24. Portfolio Use

By engaging our services, you grant Sound Mind Media Co. the right to feature your brand, content, campaigns, and results in our portfolio, case studies, and marketing materials unless otherwise agreed in writing. This includes displaying work across our website, social media, and sales presentations.

If you wish to restrict portfolio use of your materials, please notify us in writing before your project begins. Restrictions agreed upon in writing will be honored for the duration of our engagement.

25. Content Revisions

All service packages include a defined number of revisions as specified in your service agreement. Revision requests must be submitted within the timeframe outlined in your agreement. Requests submitted after this period may be subject to additional fees.

A revision is defined as a modification to existing content within the original scope of work. Requests that constitute a change in direction, new concept, or expanded scope are not considered revisions and will be billed accordingly.

26. Client Responsibilities

To ensure successful delivery of services, clients are responsible for:

  • Providing timely feedback, approvals, and all necessary materials (logos, brand guidelines, account access) as requested.
  • Ensuring all materials provided to us are owned by or licensed to the client and do not infringe on any third-party rights.
  • Maintaining active and properly configured social media accounts where services are being rendered.
  • Communicating changes in business direction, products, or services that may affect content strategy.

Delays caused by the client's failure to provide required materials or approvals may affect timelines and are not the responsibility of Sound Mind Media Co.
